Episcopal Health Services has reached a Settlement in a class action lawsuit involving a Data Incident that occurred between August 28, 2018 and October 5, 2018.


A Settlement Agreement has been reached in a class action lawsuit (the “Lawsuit”) alleging that, between August 28, 2018 and October 5, 2018, one or more email accounts at Episcopal Health Services, Inc. (“EHS”) containing information pertaining to Class Members was accessed by unknown, unauthorized user(s) (the “Data Incident”).  The information exposed included names, addresses, dates of birth, medical information, and/or Social Security numbers of some Class Members.

As part of this Settlement, EHS has agreed to reimburse eligible Class Members for certain types of claims, provide Identity Monitoring Services, and undertake certain preventative cyber security measures. You must submit a Claim using a Claim Form in order to receive any recovery under the Settlement Agreement.

Submit a Claim Form
Deadline:April 19, 2021

Complete and submit a Claim Form and receive compensation.
By completing and submitting a timely and valid Claim Form accompanied by proper documentation, you may recover money depending on your Claim(s) and the total Claims by other Settlement Class Members.


Receive Identity Theft    Protection Services

You may enroll in Identity Monitoring Services through Kroll for 24 months by following the instructions you received in the mailed Notice. You must enroll and activate this coverage by April 19, 2021.



Ask to be Excluded
Deadline:April 19, 2021

Exclude yourself from this Lawsuit, meaning you will receive no benefits from this Settlement and will not be bound by the release of claims.
Instead of submitting a Claim Form, you may ask to be excluded from the Lawsuit. By excluding yourself, you cannot recover as part of this Settlement and you are not bound by its release of claims.  If you exclude yourself from the Settlement, you may not Object to the terms of the Settlement. To exclude yourself from the Settlement, you must follow the instructions in FAQ 9.

Deadline:April 19, 2021

Object to the terms of the Settlement.
You may Object to the terms of the Settlement and have your objections heard at the Final Approval Hearing on June 21, 2021.  To Object to the Settlement, you must follow the instructions in FAQ 10.


Do Nothing

You will not receive compensation or additional Identity Monitoring Services and you will give up your rights to sue EHS about issues related to the Data Incident.
